UpTaskPro Milestone Dispute Resolution Policy

This policy outlines the process for resolving disputes between clients and Task Pros who have utilized the Milestone Payment system on UpTaskPro.


1. Dispute Resolution Team

Both parties involved in a dispute may choose to have their case arbitrated by UpTaskPro's Dispute Resolution Team. The team's role is to impartially and thoroughly resolve the dispute based on the evidence provided. The decision made by the Dispute Resolution Team is final, binding, and irreversible.


2. User Responsiveness


Clients

Once a dispute is initiated, the client has 14 days to respond. Failure to respond within this timeframe will result in the dispute being resolved in favor of the Task Pro, and the disputed Milestone Payment will be released to them.


Task Pros

Once a dispute is initiated, the Task Pro has 4 days to respond. Failure to respond within this timeframe will result in the dispute being resolved in favor of the client, and the disputed Milestone Payment will be refunded to them.


3. Milestone Dispute Resolution Process


Stage 1: Identifying the Issue

The party initiating the dispute should select the relevant project and the specific Milestone Payment(s) in question. A detailed description of the issue and the reason for initiating the dispute should be provided. Supporting documents and evidence are encouraged to be attached at this stage.


Stage 2: Negotiations

During this stage, both parties have the opportunity to negotiate and reach a mutual agreement. The party who initiated the dispute has the option to cancel it if a resolution is achieved. If negotiations fail, either party can choose to escalate the dispute to arbitration by paying the Arbitration Fee.


Stage 3: Final Offers and Evidence

After one party pays the Arbitration Fee, the other party has 4 days to also pay the fee to proceed to arbitration. During this period, both parties can continue to negotiate and submit any final evidence to support their case. No further evidence will be accepted after this stage.


Stage 4: Arbitration

In this final stage, the Dispute Resolution Team reviews all submitted evidence and information to make a decision, typically within 48 hours. The party who wins the dispute will have their Arbitration Fee refunded.


4. Evidential Requirements

Parties are encouraged to submit all relevant documents and evidence to support their claims. This may include:

  • Text correspondences (submitted as screenshots or .eml files).
  • Instant messenger conversations (submitted as screenshots).
  • Contracts, project files, and other related documents.

UpTaskPro will maintain the confidentiality of the project and the privacy of the users involved, releasing information only as required by law.


5. Arbitration Fee

The fee for a Milestone dispute is $5.00 USD or 5% of the total disputed amount, whichever is greater, payable by each party. The fee will be refunded to the party who wins the dispute.


Note: This policy is designed to ensure a fair and transparent process for resolving disputes related to Milestone Payments on UpTaskPro. Users are encouraged to communicate openly and attempt to resolve issues amicably before initiating a dispute.
